Court Orders Arrest of CID Boss, 1 Other

…Says Nobody Is Above The Laws Of Ghana  

The High Court in Accra, has issued a bench warrant for the arrest of the Director General (D-G) of Criminal Investigation Department (CID) and the D-G of the Legal and Prosecution Unit, both of the Ghana Police Service.

The arrest orders issued by the Court, presided over by Justice Lydia Osei Marfo, followed persistent failure by the two senior officers to appear in court to answer for alleged contempt charges in a case involving Sure word Global Outreach.

The court’s decision came in response to an application filed by Sureword Global Outreach, seeking an order for the respondents to release a vehicle with registration number GN 2925-20 to the applicant.

During proceedings yesterday, April 15, Starrfm.com.gh, reports that Counsel for the applicant, Abraham Arthur, moved an application for the committal of the CID boss and the D-G of the Legal and Prosecution Unit for contempt for blatantly disobeying the court’s orders.

“The orders have been carried out but the respondents are not in court,” the report quoted Arthur to have argued.

Nobody Above The Law

The presiding judge in response after hearing submission by Counsel for the applicant, expressed disappointment at the respondents’[CID boss and D-G Legal and Prosecution] failure to comply with the court’s directives.

The judge reportedly indicated that, the Court, has extended enough courtesy to the two senior police officers to appear, but have refused.

Before issuing the bench warrant for their arrest, the Court, reportedly said that nobody is above the laws of Ghana.

“There is evidence on record to indicate that this court’s orders have been carried out,” the Court said.

It added that, “There is affidavit of service which indicates that, the order of the court to serve on the IGP through Inspector Boatemaa Juliana his secretary at Cantonment.

“Equally, the previous order was served on the IGP through Inspector Alexander Nsiah, Secretary at Cantonment on March 26,2024.

This court has extended enough courtesy to these public officers and due to the fact that there is no body above the law”.

“I hereby issue a bench warrant for the arrest of the respondents – Director General of the Criminal Investigation Department and Director General Legal and Prosecution unit of CID of the Ghana Police Service,” Starrfm.com.gh quoted proceedings at court.

Background

The background of the case reveals that, the dispute revolves around the police refusal to release a vehicle with registration number, GN2925-20, to Sureword Global Outreach.

Despite a court order issued on January 29, 2024, directing the respondents to release the vehicle, they allegedly refused to comply, prompting the contempt proceedings.

In response to the persistent defiance of court orders by the respondents, the applicant, through an affidavit, sought an Order of Committal for Contempt against them, citing their actions as a disregard for the sanctity of the court and an attempt to bring the administration of justice into disrepute.

The court, having exhausted all avenues for compliance, has now taken the significant step of issuing a bench warrant for the arrest of the CID Director General and the Director General of the Legal and Prosecution Unit of CID of the Ghana Police Service, the report indicated.
